Spousal support in a Modesto case is usually tied to bigger decisions about your family’s future, so it helps to see how everything fits together. Start with our California spousal support law page for the key factors courts weigh, then explore the related matters our Modesto team also handles, each with its own page:

  • Divorce: The full divorce process, from filing to the final decree.
  • Child Custody: Legal and physical custody, and how parenting time gets decided.
  • Child Support: Setting, modifying, and enforcing support for your children.
  • Property Division: Dividing community and separate property, including businesses and real estate.
  • Paternity: Establishing legal fatherhood and the rights that follow.
  • Guardianship: Giving a caregiver legal authority over a child when a parent cannot provide care.

Where You Are, Where Your Case Is Heard

Our Modesto office serves families in Stanislaus county. Spousal support is usually decided as part of a divorce or legal separation case, so the court that hears it generally follows where that case is filed, and the table below shows where each county’s family law cases are filed.

Frequently Asked Questions About Modesto Spousal Support

Where are spousal support requests decided for Modesto residents?

Spousal support requests for Modesto residents are generally decided by the Stanislaus County Superior Court’s Family Law Division at 800 11th Street, Modesto, CA 95354.

While a divorce or legal separation case is pending, either spouse can ask the Stanislaus County Superior Court for temporary spousal support (often called alimony). The request is typically made with a Request for Order (form FL-300), along with a current Income and Expense Declaration (form FL-150) that lays out your income and expenses. The clerk sets a hearing date, and the other spouse must be served with the papers. The judge then looks at each spouse’s need and ability to pay. Your consultation is a good time to go over what to gather so your request is ready to file.

Yes. Under Family Code § 2320, at least one spouse must have been a resident of California for 6 months and a resident of the county where the petition is filed for 3 months.
